Terms of Service

OVERVIEW
These Terms of Service govern access to and use of The Seasoned Home website, store, and related content, functions, tools, kitchen products, and customer services. In these Terms, “The Seasoned Home,” “we,” “us,” and “our” mean The Seasoned Home, LLC, a Limited Liability Company that operates the public-facing store The Seasoned Home and uses the QIMVORA™ brand logo.

Our online Services are made available through Shopify. Shopify supplies the commerce platform that allows us to offer the Services to you.

These Terms, together with the policies incorporated or referenced here, explain the responsibilities and rights that apply when you interact with the Services. They contain important legal provisions, including limitations of liability and warranty disclaimers, so please review them carefully.

Accessing, browsing, purchasing from, or otherwise using the Services means that you accept these Terms and our Privacy Policy. Do not use the Services when you do not agree with either document.

SECTION 1 - ELIGIBILITY, ACCESS, AND ACCOUNTS
By accepting these Terms, you confirm that you have reached the age of majority where you live. You also confirm that you may authorize any minor dependent under your care to use the Services on a device that you own, purchase, or manage.

Certain activities, including browsing the online store or ordering products and services, may require information such as an email address, billing details, payment data, and a shipping address. Any information you submit must be accurate, complete, current, and provided with the necessary legal rights or permissions.

You are responsible for protecting account login information and for every action taken through your account. An account may not be sold, licensed, transferred, or assigned to another person.

SECTION 2 - PRODUCT INFORMATION
We work to present QIMVORA™ kitchen products and related services as accurately as reasonably possible. Screen type, device settings, display configuration, and similar technical factors may cause colors, finishes, proportions, or other visual details to appear differently from the actual item.

We do not promise that a purchased product or service will look exactly as it appeared on a particular device or that its appearance or quality will satisfy every individual expectation.

Product descriptions may be revised at our discretion without advance notice. We may stop offering an item at any time, and we may restrict quantities offered to a person, location, geographic area, or jurisdiction on a case-by-case basis.

SECTION 3 - ORDER SUBMISSION AND ACCEPTANCE
Submitting an order is an offer to buy the selected merchandise. The Seasoned Home may approve or reject that offer for any reason at its discretion. An order becomes accepted only after we confirm acceptance, and payment must be received and processed before acceptance is complete.

Review all order information before submission. After acceptance, a cancellation request may no longer be possible. When an order is declined, changed, or canceled, we will make a reasonable effort to contact you using the email address, billing address, or phone number supplied with the order.

Returns and exchanges are available only as described in our Return and Refund Policy.

By making a purchase, you state that the products are intended for personal or household use rather than commercial resale or export.

SECTION 4 - PRICING, PROMOTIONS, AND BILLING
Product prices, promotional offers, and discounts may be changed at any time without prior notice. The amount charged will be the price shown when the order is placed and identified in the order-confirmation email.

Unless a listing clearly states otherwise, displayed prices exclude applicable taxes, shipping costs, handling charges, customs duties, and import fees.

Pricing on our online store may differ from pricing at physical retail locations or on websites and stores operated by other parties. Separate conditions may apply to a particular promotion. When those promotional conditions conflict with these Terms, the conditions of the promotion control.

You must provide accurate, complete, and current account, purchase, billing, and payment details. Information such as an email address, card number, and expiration date must be updated promptly when it changes so that transactions can be completed and we can contact you when necessary.

When card information is submitted, you confirm that:

The information is truthful, complete, and correct

You are authorized to use the card for the purchase

The card issuer will honor the submitted charges

You will pay the listed product price together with any shipping, handling, and applicable tax amounts

SECTION 5 - SHIPPING AND DELIVERY
Transit and delivery dates are estimates and are not guaranteed. The Seasoned Home is not responsible for delays caused by carriers, customs procedures, or circumstances beyond our reasonable control.

Ownership of the merchandise and the risk of loss transfer to you when the order is handed to the shipping carrier.

SECTION 6 - INTELLECTUAL PROPERTY RIGHTS
The Services and their contents are protected by intellectual-property laws in the United States and other countries. Protected materials include, without limitation, trademarks, brand elements, written copy, displays, photographs, graphics, customer reviews, videos, audio, page design, selection, and arrangement. These materials belong to The Seasoned Home, LLC, its affiliates, or its licensors.

You may use the Services only for personal, noncommercial purposes. Without prior written permission, you may not reproduce, copy, distribute, alter, publish, publicly display, publicly perform, create derivative works from, download, store, republish, or transmit any portion of the Services.

Nothing in these Terms gives you a license or ownership interest in any patent, copyright, trademark, or other intellectual property belonging to The Seasoned Home, LLC, Shopify, or another party. Unauthorized use may violate federal or state intellectual-property law. All rights not expressly granted remain reserved.

The Seasoned Home name, the QIMVORA™ logo, and our product names, service names, designs, slogans, and related identifiers are trademarks or protected brand assets of The Seasoned Home, LLC, its affiliates, or licensors and may not be used without written authorization. Shopify’s name, logo, designs, product names, service names, and slogans belong to Shopify. Other names, logos, designs, products, services, and slogans appearing through the Services remain the property of their respective owners.

SECTION 7 - THIRD-PARTY OPTIONAL TOOLS
From time to time, the Services may provide access to tools supplied by outside providers. We do not control, supervise, or provide input into those tools.

Such access is offered on an “as is” and “as available” basis, without endorsement and without any representation, condition, or warranty. We are not liable for claims or losses resulting from the use of an optional third-party tool.

Your decision to use any optional tool is made at your own risk. Before using one, review and accept the terms imposed by the applicable provider.

Any future functions, tools, or resources introduced through the Services will also be treated as part of the Services and will be governed by these Terms.

SECTION 8 - EXTERNAL CONTENT AND LINKS
The Services may display third-party materials, embedded functions, or links to websites operated by others. We do not undertake to examine, verify, or assess the accuracy of outside content or websites.

Leaving our Services to visit an external resource is your choice and is done at your own risk. The Seasoned Home is not responsible for damage or loss connected with third-party websites or with any product, service, resource, or content obtained through them.

Review the policies and business practices of the third party before completing a transaction. Any complaint, question, concern, or claim involving an outside product or service must be directed to that provider.

SECTION 9 - OUR RELATIONSHIP WITH SHOPIFY

Shopify provides the platform that powers The Seasoned Home and makes the Services available. Purchases and sales completed through the store, however, are transactions directly between you and The Seasoned Home, LLC.

By using the Services, you agree that Shopify is not responsible for any element of a sale between you and The Seasoned Home, including injury, damage, or loss related to products or services purchased from us. You expressly release Shopify and its affiliates from claims, liabilities, and damages connected with transactions or purchases made through The Seasoned Home.

SECTION 10 - PERSONAL INFORMATION AND PRIVACY
Personal information gathered through the Services is handled under our Privacy Policy, available on the Privacy Policy page. Certain information may also be governed by Shopify’s privacy policy. Use of the Services confirms that you have reviewed these policies.

Because Shopify hosts the Services, it processes information concerning your access to and use of the store so that it can provide and improve the platform. Data submitted through the Services may be transmitted to Shopify and other service providers, including parties located outside the country where you live. Our Privacy Policy contains further information about the ways The Seasoned Home, Shopify, and our partners use personal information.

SECTION 11 - COMMENTS, REVIEWS, AND OTHER FEEDBACK
Any review, suggestion, idea, plan, proposal, message, or other material that you email, upload, post, submit, or otherwise provide is referred to in these Terms as “Feedback.”

When you provide Feedback, you give The Seasoned Home a worldwide, perpetual, royalty-free, sublicensable license to reproduce, modify, publish, distribute, display, and otherwise use that material in any medium and for any purpose, including commercial purposes. This permission may be used to operate, evaluate, provide, promote, improve, or expand the Services and to carry out our rights and obligations under these Terms.

You represent that:

You own the Feedback or otherwise hold every right needed to submit it

You have disclosed any payment, benefit, or incentive received in connection with it

The Feedback complies with these Terms

We are not required to keep Feedback confidential, compensate you for it, or respond to it.

We may review, edit, or remove Feedback, but are not obligated to do so, when we determine that it is unlawful, threatening, offensive, defamatory, libelous, pornographic, obscene, objectionable, infringing, or otherwise inconsistent with these Terms.

Feedback must not violate copyrights, trademarks, privacy rights, personality rights, or any other personal or proprietary rights. It must not contain unlawful, abusive, defamatory, or obscene material, viruses, or malware capable of affecting the Services or a related website.

You may not submit Feedback under a false email address, impersonate another individual or organization, or misrepresent where the material originated. You alone are responsible for the accuracy and content of what you submit. The Seasoned Home does not accept responsibility or liability for Feedback supplied by you or by another party.

SECTION 12 - CORRECTIONS AND UPDATES
The Services may occasionally contain mistakes, missing information, or inaccuracies involving product descriptions, prices, promotions, offers, shipping charges, transit estimates, or availability.

We may correct an error, revise information, or cancel an affected order at any time and without advance notice, including after the order has been submitted.

SECTION 13 - UNACCEPTABLE USE OF THE SERVICES
The Services may be used only for lawful purposes. You may not use or access them, directly or indirectly:

To upload, download, send, receive, use, or reuse material that does not comply with these Terms

To send or arrange the sending of spam, junk mail, chain letters, unsolicited promotions, or similar solicitations

To impersonate or attempt to impersonate another person or entity

In any manner that restricts another person’s use or enjoyment of the Services or that, in our judgment, may harm The Seasoned Home, Shopify, or users of the Services, or expose them to liability

You also agree not to:

Introduce viruses or other harmful code that could interfere with the Services

Copy, reproduce, duplicate, sell, resell, or exploit any portion of the Services

Collect or track another person’s personal information

Spam, phish, pharm, pretext, crawl, scrape, or use spiders

Bypass or interfere with security functions of the Services, related websites, other sites, or the Internet

We may suspend, disable, or terminate an account without notice when we determine that these Terms have been violated.

SECTION 14 - ENDING ACCESS
We may terminate these Terms or discontinue your access to all or part of the Services at any time, at our discretion, and without notice. You remain responsible for any amount owed through the termination date.

Provisions concerning Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any term that is intended by its nature to continue will survive termination.

SECTION 15 - WARRANTY DISCLAIMER
Material provided through the Services is intended for general informational use. We do not represent that it is accurate, complete, or useful for every purpose. Any reliance on that material is at your own risk, and we disclaim liability for reliance by a visitor, customer, or any person who receives the information.

EXCEPT WHERE THE SEASONED HOME EXPRESSLY STATES OTHERWISE, THE SERVICES AND EVERY PRODUCT MADE AVAILABLE THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE EXTENT PERMITTED BY LAW, NO EXPRESS OR IMPLIED REPRESENTATION, WARRANTY, OR CONDITION APPLIES, INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, OR NON-INFRINGEMENT.

WE DO NOT PROMISE THAT ACCESS TO OR USE OF THE SERVICES WILL BE CONTINUOUS, TIMELY, SECURE, OR FREE FROM ERRORS. SOME JURISDICTIONS RESTRICT OR PROHIBIT THE EXCLUSION OF IMPLIED OR OTHER WARRANTIES, SO PART OR ALL OF THIS DISCLAIMER MAY NOT APPLY TO YOU.

SECTION 16 - LIMITS ON LIABILITY
TO THE MAXIMUM EXTENT ALLOWED BY LAW, THE SEASONED HOME, LLC, TOGETHER WITH ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY CLAIM, LOSS, OR INJURY OR FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES.

THIS EXCLUSION INCLUDES LOST PROFIT, REVENUE, SAVINGS, OR DATA; REPLACEMENT COSTS; AND SIMILAR LOSSES, WHETHER THE CLAIM ARISES UNDER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANOTHER LEGAL THEORY. IT APPLIES TO USE OF THE SERVICES, PRODUCTS PURCHASED THROUGH THEM, ERRORS OR OMISSIONS IN CONTENT, AND DAMAGE OR LOSS RESULTING FROM CONTENT OR PRODUCTS POSTED, TRANSMITTED, OR OTHERWISE PROVIDED THROUGH THE SERVICES, EVEN WHEN THE POSSIBILITY OF SUCH LOSS WAS DISCLOSED.

SECTION 17 - INDEMNITY
You agree to defend, indemnify, and hold harmless The Seasoned Home, LLC, Shopify, and our respective affiliates, partners, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, or damages, including reasonable attorneys’ fees, arising from:

Your violation of these Terms or a document incorporated by reference

Your violation of law or another party’s rights

Your access to or use of the Services

We will provide notice of a claim that is subject to indemnification. A delay in notice will not release you from the obligation unless the delay materially harms your ability to respond.

At your expense, we may direct the defense and settlement of the claim, including the choice of counsel. We will not agree to a settlement imposing a nonmonetary obligation on you without your consent, which may not be unreasonably withheld. You must cooperate in the defense, including by supplying relevant records or documents.

SECTION 18 - SEVERABILITY
When a provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the greatest extent the law permits. The unenforceable portion will be separated, and the remainder of the Terms will continue in full effect.

SECTION 19 - NO WAIVER; COMPLETE AGREEMENT
A failure by The Seasoned Home to exercise or enforce a right or provision does not waive that right or provision.

These Terms, together with the policies and operating rules posted on or relating to the Services, form the complete agreement between you and us concerning use of the Services. They replace all earlier or contemporaneous proposals, communications, understandings, and agreements, whether written or oral, including prior versions of these Terms.

Unclear language in these Terms will not be interpreted against the party that drafted it.

SECTION 20 - ASSIGNMENT
You may not assign, transfer, or delegate these Terms or any related right or obligation without our prior written approval. An attempted transfer without approval is void.

We may assign, transfer, or delegate our rights and obligations under these Terms without obtaining your consent or providing advance notice.

SECTION 21 - GOVERNING LAW AND VENUE
These Terms and any separate agreement through which we provide the Services are governed and interpreted according to the laws applicable in the federal, state, or territorial jurisdiction where The Seasoned Home, LLC is headquartered.

You and The Seasoned Home, LLC agree to the personal jurisdiction and venue of the courts located in that jurisdiction.

Headings are included only to help organize these Terms. They do not change, limit, or control the meaning of any provision.

SECTION 23 - REVISIONS TO THESE TERMS
The latest version of the Terms of Service may be reviewed on this page at any time.

We may revise, replace, or update any portion by posting the change on the website. You are responsible for checking the site periodically. Material revisions will be communicated as required by applicable law and will take effect on the date stated in the notice.

Continued access to or use of the Services after updated Terms are posted constitutes acceptance of the revised Terms.
